Lurapets Terms of Service

I - Introduction: The services provided by Lurapets.com (collectively referred to as, "Lurapets," and, "the site"), are operated by the directors, employed contractors, and recognized volunteers of the site (collectively referred to as, "the staff" and, "we"). By accessing or using the services (defined in section two), provided by the staff at Lurapets.com, you signify that you agree to be bound to the Terms of Service outlined herein. We reserve the right at our sole discretion however, to change, modify, add, or delete portions of these Terms of Service, at any time, without further notice to any users of the site. Your continued use of the site after any such alterations constitutes your acceptance of the new Terms of Service.

II - Description of Service: The services provided at Lurapets.com by the staff, are defined as the ability to view and reproduce, under the conditions of the limited licensing agreement outlined in section five, any content that appears on the site (including but not limited to text, images, audio, and video), as well as to partake in various user-based features, and to submit data into various submission fields throughout the site. The use of this service, while available free of charge, is by no means the right of any individual, group, or entity, and as such, use can be terminated or denied at the sole discretion of the staff.

III - Eligibility: The use of services provided by the staff at Lurapets.com is void where prohibited. This site is intended solely for users who are thirteen (13) years of age or older, per United States Federal Law (COPPA), and have an interest in the content of the site. Any registration, use of services, or access to the site by anyone under 13 years of age, is unauthorized, unlicensed, and in direct violation of these Terms of Service.

IV - Copyright Notice: All content which is available by any means through Lurapets, including designs, text, graphics, pictures, video, information, applications, software, music, sound, art, and other files, and their selection and arrangement, are the property of the directors of Lurapets.com, with all rights reserved. No content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the written consent of the staff and their respective licensors.

V - Limited License: Provided that you are eligible for use of the site, as described in section three, you are granted a limited license to access and use any content appearing within Lurapets, and to download or display a copy of any portion of the content to which you have properly gained access, provided that you keep all copyright or other proprietary notices intact. Any use of site content other than as specifically authorized herein, without the prior written consent of the directors of Lurapets and its licensors, is strictly prohibited and will terminate the license granted above. Selling, trading, or exchanging any asset that is stored within the Lurapets database or protected by the copyright claim made by Lurapets.com, for anything other than additional assets stored within the Lurapets database, is strictly prohibited. This license is revocable at any time, without notice, and with or without cause.

VI - Submission Policy: You represent that you understand that any content that you submit, directly or indirectly to Lurapets, becomes the immediate and sole property of the directors of Lurapets, to the utmost extent, as, provided by United States & International Copyright laws. All content which is the property of the staff and Lurapets.com may be used or altered in anyway as is deemed appropriate by the directors.

VII - Member Conduct: You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the site, will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material. In addition, you agree not to use the site to:

• Harvest or collect email addresses or other contact information of other users of the site by electronic or other means, for the purposes of sending unsolicited communications;
• Use the site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the site, or another user�s account;
• Register for more than one user account, or transfer access to your account to another user;
• Register for a user account on behalf of an individual other than yourself, or register for a user account on behalf of any group or entity without their explicit permission;
• Upload, post, transmit, share, store or otherwise make available any content that the staff may deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
• Upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
• Impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity, particularly Lurapets.com;
• Intimidate or harass another user by any means;

You are solely responsible for the images, messages, notes, text, information, music, video, listings, and other content that you upload, publish or display, on or through the site, or transmit to or share with other users of Lurapets. Additionally, you agree to be bound to any rules and further conditions posted throughout the site, which are directly related to specified services available on Lurapets.com.

VIII - Site Operation: You are solely responsible for your interactions with other users of Lurapets. However, the staff reserves the right, but has no obligation, to monitor and mediate disputes between you and other users. The staff may terminate or suspend your user account, delete your profile and any content or information that you have posted on the site, and/or prohibit you from using or accessing the site for any reason, or no reason at all, at any time, in its sole discretion, with or without notice.

IX - Monetary Exchanges: As specified in section five, users may not sell, trade, or exchange any asset that is stored in the Lurapets database or protected by a copyright claim made by Lurapets.com, for any other asset unless it to is stored in the Lurapets database. The only instance in which a user can trade real-world currency for assets that are stored in the Lurapets database is when in direct negotiation with the directors of Lurapets.com. Should a user exchange real-world currency for assets that are stored in the Lurapets database, and then lose access to their account, by whatever means, they ultimately forfeit said assets.

X - Privacy Policy Statement: Any and all information you submit to Lurapets may be available by either electronic or physical means, to other users of the site, affiliates, partners, and the staff, at the sole discretion of the directors. Under no circumstances however, will any user-orientated information be sold or distributed amongst any third-parties.

XI - Jurisdiction & Arbitration: These Terms of Service are governed & authorized by United States Federal law. YOU AGREE THAT, EXCEPT AS MAY OTHERWISE BE PROVIDED IN REGARD TO SPECIFIC SERVICES ON THE SITE, THE SOLE AND EXCLUSIVE FORM AND REMEDY FOR ANY AND ALL DISPUTES AND CLAIMS RELATING IN ANY WAY TO, OR ARISING OUT OF THESE TERMS & CONDITIONS OR USE OF THE SITE, SHALL BE FINAL AND BINDING ARBITRATION IN THE STATE OF ARKANSAS.

XII - Closing: These Terms & Conditions constitute the entire agreement between you and Lurapets regarding your use of the site, superseding any prior agreements between you and Lurapets relating to your use of the site. The failure of Lurapets.com to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this agreement is held invalid, the remainder of this agreement shall continue in full force and effect. If any provision of these Terms of Service shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms & of Service, and shall not affect the validity and enforceability of any remaining provisions.
